These Terms and Conditions ("Terms") govern your use of our website ("Site"), which is powered by Shopify, and the purchase of products from our store ("Products"), which are fulfilled by Printful. By accessing our Site and making a purchase, you agree to comply with these Terms and any other applicable laws and regulations. Please read these Terms carefully before using our Site and making a purchase.
1 Definitions
1.1 "RushWise Apparel" refers to our company, its Site, and any affiliated entities.
1.2 "Site" refers to our website powered by Shopify, accessible at www.rushwise.ca
1.3 "Products" refer to the apparel and merchandise available for purchase on our Site.
1.4 "Printful" refers to the third-party print-on-demand service that produces and fulfills the Products.
2 Use of the Site
2.1 The Site is intended for personal and non-commercial use only. You may not use the Site for any illegal or unauthorized purpose.
2.2 You agree not to interfere with the proper functioning of the Site or attempt to gain unauthorized access to our systems.
3 Product Information
3.1 RushWise Apparel endeavors to provide accurate product descriptions, images, and pricing. However, we do not guarantee that the product information is error-free, complete, or up-to-date. We reserve the right to correct any errors, inaccuracies, or omissions and to update product information at any time without prior notice.
4 Product Orders
4.1 By placing an order for Products on our Site, you are offering to purchase the selected Products, subject to these Terms.
5 Pricing and Payment
5.1 All prices displayed on the Shopify platform are in the currency specified on the website.
5.2 All payments for Products must be made through the payment methods available on the Site.
5.3 RushWise Apparel reserves the right to change product prices at any time without prior notice.
5.4 Payments for orders are processed securely through Shopify's payment gateway. RushWise Apparel does not store or have access to your payment card details.
6 Shipping and Fulfillment
6.1 By placing an order, you make an offer to purchase the selected item(s) from RushWise Apparel. We reserve the right to accept or decline your order at our sole discretion.
6.2 All Products are produced and fulfilled by Printful, and their shipping and fulfillment policies apply.
6.3 Order fulfillment and shipment will be subject to product availability and successful payment processing.
6.4 RushWise Apparel aims to fulfill orders promptly; however, we do not guarantee delivery times as they may vary based on location and external factors beyond our control. RushWise Apparel is not liable for any delays caused by shipping carriers.
6.5 RushWise Apparel ships to addresses within the regions specified on the Shopify platform. Customers are responsible for providing accurate shipping information.
6.6 Shipping costs are calculated based on the delivery location and the weight of the order. The customer will be informed of the shipping costs at the checkout stage.
6.7 Risk of loss and title for ordered items pass to the customer upon delivery to the shipping carrier.
7 Returns and Refunds
7.1 Printful's return and refund policies apply to all Product purchases. Please review their policies on their website for more information.
7.2 RushWise Apparel is not responsible for any defects or issues with Products resulting from Printful's production processes.
8 Intellectual Property
8.1 All content on the Site, including text, graphics, logos, and images, is the property of RushWise Apparel or its licensors and is protected by copyright and other intellectual property laws.
8.2 You may not reproduce, distribute, modify, or create derivative works based on the content of the Site without prior written consent from RushWise Apparel.
9 Limitation of Liability
9.1 RushWise Apparel and Printful shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the Site or Products.
9.2 You agree to indemnify and hold RushWise Apparel harmless from any claims, losses, or damages arising from your use of the Site or Products.
